Allahabad HC Cancels Student's NSA Detention, Fines Noida DM

· India · India Today, The Hindu

The Allahabad High Court cancelled the National Security Association detention of 25-year-old Delhi University student Akriti Chaudhary, who was arrested during a workers' protest in Noida in April. A bench of Justices Atul Sreedharan and Achal Sachdev ruled that the detention order by Gautam Buddha Nagar DM Medha Roopam showed non-application of mind and violated fundamental rights. The court warned that despotic conduct by errant officials could turn Uttar Pradesh into an Orwellian Dystopia. The bench awarded Chaudhary Rs 5 lakh in compensation, directing that the amount be recovered from the salary of the DM and other responsible officers down to the Station House Officer. The state government failed to present a single message or video showing Chaudhary inciting violence during the agitation for higher wages and humane working hours.

Why it matters

The ruling sets a strong judicial precedent against the arbitrary use of stringent preventive detention laws against student activists and civil rights advocates.
