Allahabad High Court Rules Homebuyers Can Claim Compensation for Delayed Flats

The Allahabad High Court has held that accepting possession of a delayed flat does not take away a homebuyer's legal right to claim compensation. The ruling came in the case of Shyam Sunder Agrawal, a 48-year-old government official who booked a 3BHK flat for Rs 43 lakh at Antriksh Golf View in Noida Sector 78 in April 2010. Although promised possession by 2012, Agrawal received the keys only in March 2017, forcing him to pay Rs 40,000 monthly rent in Vasant Kunj alongside a Rs 20,000 home loan EMI. The Lucknow bench of the High Court upheld a previous Real Estate Appellate Tribunal decision granting Agrawal interest for the delay period from December 2012 to March 2017. The court confirmed that such compensation claims remain maintainable under the proviso to Section 18(1) of the Real Estate (Regulation and Development) Act.
