Assam Told to Pay ₹2 Lakh to Husband of Woman Pushed Into Bangladesh

The Gauhati High Court has ordered the Assam government to pay ₹2 lakh as interim compensation to Mujammel Hoque, whose wife Mumtaz Begum was expelled to Bangladesh without an opportunity to challenge a tribunal order. A Division Bench comprising Justices Kalyan Rai Surana and Susmita Phukan Khaund delivered the September 3 ruling after hearing a habeas corpus petition. The court observed that malice in law on the part of the Foreigners’ Tribunal in central Assam’s Nagaon was evident from the record, noting that Ms. Begum was arrested immediately after being informed of the May 30 order that declared her a foreigner. The High Court also impleaded the Ministry of External Affairs in the case, advising it to locate the woman in Bangladesh and repatriate her to India. This marks the first instance of any court imposing a cost on the state for deporting a person across the border in violation of deportation rules.
