Bombay HC raps OCI cardholders, extends interim relief to Imran Khan

· India · Hindustan Times, India Today, Times of India

The Bombay High Court on Monday ruled that Overseas Citizen of India cardholders are at the mercy of the country and cannot live in India while criticising it, while granting interim relief to actor Imran Khan over a 'Leave India' notice. Khan, a US citizen, was allowed to stay after tendering an unconditional apology for allegedly participating in a protest against the Special Intensive Revision of electoral rolls at August Kranti Maidan on October 10. The court questioned Khan's presence at the protest, noting he is not an Indian citizen and has no voting rights. The bench also warned that one statement from a celebrity like Khan can have a decisive effect on young followers. The next hearing is scheduled for December 7.

Why it matters

The ruling places OCI cardholders at the mercy of the state, restricting their right to critique the government while living in India, and reinforces that foreign citizens with OCI status face stricter limitations than citizens.
