Bombay High Court Allows Five Mumbai Eateries to Reopen

The Bombay High Court has vacated the Maharashtra Food and Drug Administration’s suspension order against five restaurants located on the Mumbai Cricket Association premises in the Bandra-Kurla Complex. Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad issued the order after a fresh inspection report confirmed the eateries were 88 per cent compliant with food safety regulations. The court criticised the FDA for taking a pedantic approach to the matter, noting that no legal provisions prohibited the current operational arrangements. While the restaurants may resume services, the FDA has been directed to issue a fresh notice to the Mumbai Cricket Association regarding its contract with M/s Shirke Infrastructure. The FDA must now conduct a hearing and pass a reasoned order on the third-party operation issue.
