Bombay High Court Slams FDA Over Restaurant Licence Suspensions at MCA Premises

The Bombay High Court criticised the Maharashtra Food and Drug Administration for acting with undue haste and taking a pedantic view instead of a pragmatic approach regarding the food licences of five eateries. A division bench of Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad warned of contempt action against officials after the department refused to lift suspensions despite a fresh inspection showing 88% compliance with food safety rules. The five restaurants, located at the Mumbai Cricket Association premises in Bandra-Kurla Complex, had their licences contested due to third-party operations managed by M/s Shirke Infrastructure. Accepting an undertaking that the FDA would issue a fresh notice to the MCA and provide a hearing on the contractual arrangement, the court vacated the suspension and allowed the eateries to reopen immediately.
