Can Bangladesh Extradite Sheikh Hasina Under India Treaty?

Bangladesh has formally requested that India extradite former Prime Minister Sheikh Hasina to face charges related to the July-August 2024 uprising. The request follows a demand from Dhaka for India to create a propitiate environment for Prime Minister Tarique Rahman’s visit by facilitating the handover. While the 2013 extradition treaty between India and Bangladesh allows for the mutual transfer of individuals wanted for criminal offences, it includes a specific provision for political offenders. Article 6 of the agreement states that extradition may be refused if the offence is of a political character, though it excludes crimes such as murder and kidnapping from this protection. Sheikh Hasina has remained in India since departing Dhaka on August 5, 2024.

The extradition request creates a significant diplomatic challenge for India, balancing its bilateral treaty obligations with Bangladesh against the political asylum of a former head of state.
