The Union government has moved applications before the Supreme Court seeking to exempt the 2025 and 2026 Civil Services Examinations from the retrospective application of its March 11 creamy layer judgment. Filed through the Department of Personnel and Training, the plea argues that applying the ruling retrospectively would trigger a cascade of litigation and impact lakhs of past OBC recruitments and admissions across ministries, state departments, and universities. The legal dispute stems from the Rohith Nathan case, in which the Supreme Court ruled on how parental salaries and incomes determine the creamy layer for Other Backward Classes candidates whose parents work in public sector undertakings. The Centre has asked the apex court to clarify whether the interpretation applies retroactively or only prospectively to ongoing and future recruitment cycles.
