Chhattisgarh High Court Allows Couple to Pursue IVF Treatment

The Chhattisgarh High Court ruled that reproductive autonomy forms an integral part of the right to life and personal liberty under Article 21 of the Constitution. Justice Amitendra Kishore Prasad permitted a couple married for 22 years to undergo IVF treatment despite the husband, aged 57, having crossed the statutory age limit for men. The court held that treating the husband's age as an absolute bar would unfairly curtail the reproductive choice of the wife, who independently meets the statutory age requirement. The couple had previously faced rejection from an ART clinic due to the upper age limit restriction. The order clarifies that the Assisted Reproductive Technology Regulation Act does not expressly impose a composite age restriction on couples seeking treatment.
