CJI Surya Kant Emphasizes Understanding Children in Conflict With Law
· India · Times of India, Hindustan Times
Chief Justice of India Surya Kant stated that children in conflict with the law require understanding rather than just being heard, as many struggle to articulate their experiences to authorities. Speaking on the 10th anniversary of the Juvenile Justice (Care and Protection of Children) Act, he noted that many such children were previously in need of care and protection that was not provided in time. Justice B V Nagarathna, who heads the Supreme Court's Juvenile Justice Committee, added that society must address the anxieties of children to prevent feelings of alienation. The Act prioritizes restoration, counselling, and probation over confinement, aiming to help young people assume constructive roles in society.
Why it matters
The judicial focus on restorative justice for minors directly influences how the Indian legal system handles juvenile offenders, aiming to reduce recidivism by prioritizing rehabilitation over incarceration.
