CJP Leaders Custody Extended As Powers Of Special Executive Magistrates Face Scrutiny

· India · Indian Express, The Hindu

Cockroach Janta Party leaders Ashutosh Ranka and Saurav Das were sent to judicial remand for two more days after being produced before a Special Executive Magistrate at Mandir Marg police station in New Delhi. The leaders were originally arrested on October 14, 2026, for allegedly breaching security and entering Jantar Mantar during protests against the Special Intensive Revision of electoral rolls. An SEM order signed by ACP-rank officer Ritu Raj stated that the leaders' conduct did not inspire confidence and that they habitually called for protests at a de-notified site. Meanwhile, All India Students Association president Neha Bora has challenged a separate peace bond notice issued by SEM Mahesh Kumar Meena over a likelihood of a breach of peace. The detentions have brought the preventive powers of Executive Magistrates and their operational differences from judicial magistrates under intense court scrutiny.

Why it matters

Political activists and student leaders face extended detention under executive magistrate powers, raising questions about procedural safeguards and personal liberty during public demonstrations.
