Delhi HC Rules Student Union Membership Does Not Equal Political Party Association

The Delhi High Court held that mere membership of a student union backed by a political party does not constitute an association with the party for contesting Delhi University Students Union (DUSU) elections. The ruling came on a public interest litigation (PIL) filed by a DU student challenging the upcoming polls scheduled for Friday. The petitioner argued that candidates fielded by student wings such as the SFI, ABVP, AISA, and ASAP are directly governed by political ideologies and symbols. The division bench of Chief Justice D K Upadhyaya and Justice Tejas Karia refused to cancel the elections but directed university authorities and the Chief Election Officer to ensure the polls remain completely free from political interference. The court emphasized that strict compliance with Lyngdoh Committee recommendations and the DUSU Constitution must be maintained.
