Delhi High Court Dismisses Man's Divorce Plea Over 2008 Wedding

The Delhi High Court rejected a husband's appeal to dissolve his marriage nearly 18 years after the wedding, upholding a May 2018 family court order. The husband claimed he was sedated during the 2008 ceremony at an Arya Samaj Mandir and that his consent was obtained by fraud or force. A division bench comprising Justices Vivek Chaudhary and Renu Bhatnagar noted that such allegations render a marriage voidable under Section 12(1)(c) of the Hindu Marriage Act, requiring an annulment petition within one year of discovering the fraud. The court also observed that the husband made no effort to resume marital life after a 2013 court order favored the wife's petition for restitution of conjugal rights. Furthermore, the bench ruled that paying Rs 10,000 per month in maintenance does not entitle a husband to a divorce decree.
