The Delhi High Court has overturned a 16-year-old trial court acquittal that had cleared an accused of rape, ruling that courts cannot expect a four-year-old child to describe an assault using precise legal or medical terminology. In its September 2 order, a Bench of Justices Ravinder Dudeja and Navin Chawla criticized the trial court for assessing circumstances in isolation and placing excessive reliance on the victim's exact phrasing. The Delhi Police had appealed the April 10, 2010, trial court judgment which had instead convicted the man only of outraging a woman's modesty. The High Court emphasized that child witness testimony must be evaluated based on substance, trauma, and surrounding circumstances rather than technical jargon.
