EC Tells High Court Khairatabad Election Will Await Petition Verdict

The Election Commission of India informed the High Court in Hyderabad that it will not treat the Khairatabad assembly constituency as a casual vacancy or issue an election notification until a pending poll petition is resolved. Standing counsel Avinash Desai presented the ECI's stand during a writ petition filed by former corporator P. Vijaya Reddy. Reddy had lost the 2023 assembly election from Khairatabad to Danam Nagender of the BRS, after which she challenged the result in court. The High Court recently disqualified Nagender as an MLA following a separate petition filed by the BRS. Senior counsel Vedula Venkataramana, representing the petitioner, argued that Sections 84 and 98(c) of the Representation of People Act, 1951 bar the ECI from conducting a by-election while an election petition is active.
