ECI Clarifies No Penalty for Voters Re-enrolling via Form 6 During Special Intensive Revision

· India · The Hindu, Indian Express

The Election Commission of India on Tuesday said no action will be taken against electors who submit Form 6 during the Special Intensive Revision or afterwards simply because they appeared in a previous electoral roll, provided they are not enrolled elsewhere. The directive to chief electoral officers of all states and Union Territories states that voters whose names are missing from the draft roll must seek fresh inclusion regardless of prior enrolment. The commission cited a Delhi High Court ruling from October 14, 2026, which held that submitting Form 6 in such circumstances does not constitute a false declaration. The clarification addresses concerns that the form's first-time voter declaration could expose re-enrolling voters to penal provisions. Electoral Registration Officers have been instructed not to initiate proceedings under Section 31 of the Representation of the People Act, 1950, on this ground alone.

Why it matters

Voters who were dropped from the draft roll can now re-enrol without fear of legal repercussions, ensuring their franchise is protected during the ongoing revision process.
