Foreign Spouses of Indians Have No Vested Right to Visa: Kerala HC
· India · Hindustan Times, The Hindu
The Kerala High Court has ruled that a foreign national married to an Indian citizen has no vested right to demand a visa to enter the country. The ruling came while the court dismissed a petition filed by a Kerala resident and his Pakistani wife seeking a tourist visa for her to attend a family wedding. The Centre submitted that all visas issued to Pakistani nationals have been suspended since April 29, 2025, following the Pahalgam terror attacks. The court stated that the issuance of tourist visas is a sovereign function rooted in national security and foreign policy. It added that no Pakistani national can demand visa processing while the order under Section 3 of the Foreigners Act, 1946 remains in force.
Why it matters
The ruling upholds strict national security controls on cross-border travel from Pakistan, reinforcing the sovereign discretion of the state over visa issuance.
