Government Assures Supreme Court That Existing Transgender Identity Cards Remain Valid

The Union government informed the Supreme Court on August 17, 2026, that transgender identity cards issued before the Transgender Persons (Protection of Rights) Amendment Act, 2026, will retain their validity. Solicitor General Tushar Mehta provided this assurance before a three-judge Bench led by Chief Justice of India Surya Kant. The clarification comes after petitioners challenged the 2026 law, arguing it could retrospectively invalidate existing identity documents and undermine the right to self-determined gender identity. The government's transgender portal currently allows individuals to update their name and gender across official records using these cards. The Supreme Court had previously questioned the Centre on whether the new legislation would negatively impact the rights of community members already holding such identification.
