Gurgaon Court Grants Bail To Third Accused In Bhagwant Mann Video Case

· India · Indian Express, Bar and Bench, Hindustan Times

A Gurgaon court has granted regular bail to Pankaj Yadav, the third person arrested in connection with the alleged fabrication of forensic reports regarding an "objectionable" video of Punjab Chief Minister Bhagwant Mann. Yadav, who operates a training centre in Delhi, was accused of involvement in creating a report that claimed the video was AI-generated. Additional Sessions Judge Sudeep Goel criticised the police for invoking stringent organised crime provisions under Section 111 of the Bharatiya Nyaya Sanhita without providing foundational evidence. The court observed that the state cannot use custodial interrogation to fish for evidence. All three arrested individuals in the case are currently out on bail, while the police have yet to question two senior Punjab Police officers allegedly involved in the matter.

Why it matters

The court's decision highlights judicial scrutiny over the application of strict criminal laws in high-profile political cases involving state authorities.
