Justice Nagarathna Flags Weaponisation of Litigation in Family Courts

Supreme Court judge Justice B V Nagarathna stated that prolonged family litigation is sometimes weaponised to cause humiliation and financial distress to parties involved. Speaking at the Eastern Zone Regional Conference on Alternative Dispute Resolution in Guwahati, she described situations where the legal process itself turns into a form of punishment. Gauhati High Court Chief Justice Ashutosh Kumar, who presided over the event, noted that family disputes require judges to understand complex family dynamics and balance mediation with adjudication. The two-day conference was organised by the Supreme Court's Committee for Family Court Matters in association with the Gauhati High Court. Legal experts, judges, and mediators gathered at the event to discuss domestic violence, child custody, marriage, and divorce.
