Karnataka High Court Denies Agricultural Land Plea to Ex-Serviceman

· India · Hindustan Times, The Hindu

The Karnataka High Court set aside a 2022 single-judge order that had directed authorities to grant five acres of agricultural land to a landless ex-serviceman named Vemanna G. A bench comprising justices DK Singh and H Shanthi Bhushan expressed deep regret while issuing the order, noting they were bound by amended rules. The court explained that the prevailing Karnataka Land Grant Rules, 1969, only entitle an ex-serviceman to a residential site when agricultural land is unavailable. Vemanna had first applied for the land in Magadi taluk of Ramanagara district in the year 2000 under the soldiers and ex-servicemen quota. Although the state initially submitted a memo supporting the land grant during earlier proceedings, the division bench ruled that the legal amendments restricted them from upholding the original directive.

Why it matters

This ruling clarifies the legal limits of state welfare benefits for retired military personnel when specific resources like agricultural land are legally unavailable.
