Kerala to File Supreme Court Petition Over Highway Construction Ban
· India · The Hindu, Times of India
Kerala will approach the Supreme Court to contest an order that bars residential buildings within 40 metres and commercial establishments within 75 metres of national highways. P.W.D. Minister P.K. Basheer said Kerala’s high population density and limited land make the ban impractical and a deviation is needed. The order was issued after fatal accidents in northern India and requires states to issue notifications within 60 days and keep the service road and adjacent 45‑metre-wide strip free of construction. Kerala argues its closed construction system with limited access points reduces accident risk, unlike the north. The state will argue for relief to protect hundreds of acres of otherwise developable land.
Why it matters
The Supreme Court petition could change land‑use policies and impact real‑estate development in Kerala, affecting developers, landowners and local authorities.
