Madras High Court Calls For Changes in Hindu Marriage Act on Remarriage

The Madras High Court has suggested amending Section 15 of the Hindu Marriage Act to prevent spouses from facing prolonged uncertainty regarding remarriage during pending divorce appeals. Justices G R Swaminathan and M D Sumathi made the observation while dismissing an appeal filed by a husband against a 2021 family court divorce order. The court held that the right to marry is a human right and suggested requiring appellants to obtain an interim stay of the divorce decree within two months. The original marriage took place on June 3, 2001, and the wife subsequently obtained a divorce on grounds of cruelty and desertion in March 2021 before remarrying in August 2021. The husband's subsequent appeal was restored in March 2026, by which time the court noted the matter had become infructuous due to the remarriage.
