No Permission Needed to Hoist National Flag: Neha Bora Tells Delhi High Court
· India · Times of India, Hindustan Times, Live Law
All India Students' Association president Neha Bora told the Delhi High Court on Thursday that no permission is required to hoist the national flag. Bora challenged a Delhi Police notice issued under Section 126 of the BNSS directing her to execute a ₹10,000 peace bond before a Special Executive Magistrate. The police objected to the maintainability of her petition, citing previous protests around Jantar Mandir and Mandi House under Section 163 prohibitory orders. Bora was previously taken into preventive detention on October 16 while heading to the Cockroach Janata Party's 'Lehra Do Tiranga' march at Central Park in Connaught Place, before being released the next day. Her petition argues that the police notice is vague, factually incorrect, and constitutes a misuse of preventive powers to suppress peaceful dissent.
Why it matters
The case challenges the misuse of preventive detention and magistrate bonds against student activists, directly testing the constitutional boundaries of free expression and peaceful protest.
