Patna Court Convicts Man for Triple Talaq, Sentences to Two Years Rigorous Imprisonment
· India · Indian Express, Times of India
A Patna court convicted Naushad Ahmed, a resident of Bihta in Bihar, under the Muslim Women (Protection of Rights on Marriage) Act, 2019 for giving instant triple talaq to his wife in September 2022. The court sentenced him to two years of rigorous imprisonment and a fine of Rs 6,500, with an additional one month and 22 days of jail if the fine remains unpaid. Ahmed was also convicted under IPC sections 323 and 341 for voluntarily causing hurt and wrongful restraint related to an assault on his wife and children in 2022. However, he was acquitted in a separate case involving an alleged acid attack attempt on his wife due to lack of evidence. The complainant, Raziya Sultan alias Gudiya, married Ahmed in 2001 and has three children with him. The defence lawyer stated they will challenge the verdict in the High Court after reviewing the court order.
Why it matters
This marks the first conviction under the anti-triple talaq law in Bihar, setting a legal precedent for enforcing the 2019 legislation in the state. It directly affects Muslim women by providing a legal recourse against instant triple talaq, reinforcing their constitutional rights to equality and dignity within marriage.
