Punjab and Haryana High Court Upholds Property Transfer Cancellation for Failing to Maintain Elderly Parents

The Punjab and Haryana High Court has upheld the cancellation of a property transfer made by a father to his son after the son failed to provide care for his elderly parents. The case involved a factory shed measuring about 12 marlas and 28 square feet located in Jalandhar's Industrial Area, which the father had transferred in July 2017 following assurances of lifetime maintenance. Justice Kirti Singh noted that the Maintenance and Welfare of Parents and Senior Citizens Act of 2007 is a beneficial social welfare legislation designed to ensure elderly individuals live with dignity and security. The son had challenged prior orders from the sub-divisional magistrate and the deputy commissioner that annulled the gift deed. The court emphasised that property transfers under this Act carry a binding obligation of care towards aged parents.
