Refusal To Marry Alone Does Not Amount To Abetment Of Suicide: Supreme Court

· India · NDTV

The Supreme Court held that a mere refusal to marry a partner does not constitute abetment of suicide under criminal law. The case originated from the suicide of a woman who had lived with the first appellant for approximately three months before her death. A bench of justices examined whether the appellant's actions met the legal threshold of instigation or intentional aid required for abetment. The Court noted that romantic relationships ending in separation or broken marriage promises do not automatically establish criminal culpability. Consequently, the bench set aside the criminal proceedings against the appellants.

Why it matters

This ruling clarifies the legal threshold for abetment of suicide in cases involving failed romantic relationships, protecting individuals from criminal prosecution when a broken promise to marry is not accompanied by intentional instigation.
