SC declines parliamentary panel's request to interact with CJI Kant ahead of simultaneous elections

· India · Hindustan Times, The Hindu

The Supreme Court administration declined a parliamentary panel's proposal to interact with Chief Justice Surya Kant and other sitting judges, citing that proposed constitutional amendments on simultaneous elections could eventually face judicial review. The court's secretary general informed the joint committee of Parliament on Thursday that such discussions on the administrative side may not be expedient given the pending judicial scrutiny. This decision followed an internal discussion among senior judges, after which CJI Kant directed that the proposed interaction should not proceed. The proposed meeting was originally scheduled for October 6 as part of consultations on the Constitution (One Hundred and Twenty-Ninth Amendment) Bill, 2024 and the Union Territories Laws (Amendment) Bill, 2024. Earlier in the day, Rajya Sabha member Kapil Sibal publicly objected to the visit, describing it as 'unconstitutional' and contrary to the principle of separation of powers.

Why it matters

The Supreme Court's refusal to engage with the parliamentary panel preserves the perceived separation between the legislature's law-making role and the judiciary's function, ensuring that constitutional amendments on simultaneous elections remain subject to independent judicial scrutiny.
