SC Rejects Centre's Plea Against Vedanta Arbitration Awards
· India · Hindustan Times, The Hindu
The Supreme Court of India dismissed the Union government's appeal against a Delhi High Court order, allowing Vedanta Ltd and Ravva Oil (Singapore) Pvt Ltd to enforce foreign arbitration awards totalling $99 million. Justices JB Pardiwala and Manmohan criticised the Centre for resisting the enforcement of awards dating back over two decades. The court warned that such prolonged litigation could erode confidence in India's arbitration system among international investors. The dispute originated from a 1994 production-sharing contract for the Ravva oilfield in the Krishna-Godavari basin, concerning the accounting of payments towards ONGC's historical costs.
Why it matters
This ruling reinforces the enforceability of international arbitration awards in India, which is crucial for maintaining investor confidence in the country's dispute resolution mechanisms. It also means the government must pay the $99 million to Vedanta and Ravva Oil.
