SC Rules BCI Chairperson Tenure Cannot Exceed Statutory Two Years

The Supreme Court ruled Wednesday that the Bar Council of India chairperson's tenure is strictly limited to the statutorily prescribed two-year term and cannot be extended to five years by an internal resolution. A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana addressed two public interest litigations challenging the April 2025 resolution that granted chairperson Manan Kumar Mishra a five-year term. The court ordered that even with the resolution, the tenure cannot extend beyond 2027. Petitioners had also questioned alleged lavish spending on felicitation functions and the misuse of trust funds. The Supreme Court directed newly formed state bar councils to complete the co-option of women members within two weeks before conducting fresh elections for BCI representatives and leadership.
