SC Rules Delhi Metro Ban Overreach, Backs Protest Rights

· India · The Hindu, Hindustan Times

The Supreme Court on October 9, 2026, ruled that the Delhi Police’s blanket ban on Metro and rail services ahead of the October 10 protest was over-reaching and disproportionate. The court, led by Chief Justice of India Surya Kant, directed the authorities to operate Metro trains in a suitable and regulated manner rather than imposing a total shutdown. Over 20,000 police and paramilitary personnel had been deployed in central Delhi for the protest by the Cockroach Janata Party (CJP), which is demanding the resignation of Chief Election Commissioner Gyanesh Kumar. The court also suggested that the government identify a spacious, open site for peaceful protests to avoid public inconvenience.

Why it matters

This ruling protects the fundamental right to protest while ensuring public transit remains functional for Delhi’s millions of daily commuters. It sets a legal precedent that security measures must be proportionate and that complete transit shutdowns are not an acceptable default response to demonstrations.
