If a passenger persists with the nuisance after a warning from a competent railway official, penalties can escalate to simple imprisonment for up to six months and a fine of ₹5,000. The provisions are enforced under Section 145(2)(a) of the Railways Act, as amended through the Jan Vishwas Act.
