The Supreme Court in New Delhi stated it will wait for the central government's formal position on petitions seeking the criminalisation of marital rape before setting a hearing date. Senior advocate Indira Jaising, representing a petitioner, requested a November hearing, noting that the government has yet to file a substantive reply. The bench, led by Chief Justice Surya Kant, will review the government's response during a scheduled hearing this Wednesday. The petitions challenge the constitutional validity of provisions in the Bhartiya Nyaya Sanhita and the former Indian Penal Code that exempt a husband from rape prosecution if his wife is an adult. The court has been considering these legal challenges since January 2023.
