Supreme Court clarifies no approval for Form 6 alterations ahead of EC review

· India · The Hindu, Indian Express

The Supreme Court clarified on October 12, 2026, that it neither approved nor disapproved controversial alterations to Form 6 made in July 2026, which require applicants to provide ancestry details or linkage to previous SIR rolls on the ECINet portal. The May 27 judgment, entirely about the legality of the pilot Special Intensive Revision process in Bihar, predated these Form 6 changes. A bench headed by Chief Justice Surya Kant and including Justice Joymalya Bagchi orally observed that when the Bihar SIR issue was decided, the new Form 6 was not present. The remarks came in response to a petition by Priya Mishra challenging the alterations, as the Election Commission continues to justify the changes despite the CJI’s October 5 oral remark stating they were 'not approved by us'.

Why it matters

The Election Commission will now examine the Form 6 modifications, potentially affecting voter registration procedures across multiple states undergoing Special Intensive Revision exercises, while the court’s clarification ends ambiguity over judicial endorsement of the changes.
