Supreme Court Grants Interim Bail To UAPA Accused After Nearly Six Years In Custody

The Supreme Court of India has granted 10 days of interim bail to an undertrial detained for nearly six years under the Unlawful Activities (Prevention) Act. A Bench of Justices M.M. Sundresh and A.G. Masih issued the order on Friday, allowing the petitioner to care for his ailing mother and his hearing-impaired child who requires bilateral cochlear implantation surgery. The court took note of the prolonged incarceration of five years and eleven months while only 20 out of 50 prosecution witnesses have been examined. Senior advocates representing the petitioner argued that there was no likelihood of the trial concluding in the near future. The National Investigation Agency opposed the bail plea, submitting that the child's disability was long-standing and that the mother did not require urgent medical treatment.
