Supreme Court Holds Administrative Direction Is Not Suicide Abetment

The Supreme Court ruled that routine administrative directives and stern remarks by a superior do not constitute abetment of suicide under Section 306 of the IPC. In the appeal of former deputy conservator of forests Vinod Shivakumar, the Court set aside the Bombay High Court and trial court orders and discharged him of all allegations. The case stemmed from the March 25, 2021 suicide of a forest range officer in Maharashtra’s Harisal Range, who left notes blaming Shivakumar for her death. Prosecution had alleged that Shivakumar had mentally harassed the officer, issued show‑cause notices and forced her to undertake field duties despite pregnancy, which she claimed led to a miscarriage. The Court emphasised that criminal liability for abetment requires proof of conscious intent and a proximate act beyond the grief of the outcome.
