Supreme Court Refuses to Direct Urgent Hearing for Former Judicial Officer's Plea
· India · The Hindu, Times of India
The Supreme Court on Thursday refused to entertain a petition filed by a former judicial officer seeking an expedited hearing on his pending challenge against his termination before the Allahabad High Court. A Bench comprising Justices Joymalya Bagchi and V. Mohana stated that everyone has an equal right to access justice regardless of their background. The apex court observed that granting priority to the petitioner's case would be unfair to other litigants waiting for adjudication. The Bench noted that the petitioner should make his request directly to the High Court. The former judicial officer's counsel had cited the heavy caseload in the High Court as the reason for the delay.
Why it matters
The ruling reinforces the principle of equal judicial access, protecting overburdened High Courts from individual interference while setting a precedent against preferential treatment in case listings.
