Supreme Court Rules Professional Course Fees Cannot Be Changed Midstream
· India · Indian Express, Times of India
The Supreme Court of India ruled on Wednesday that tuition fees for professional education in self-financing higher education institutions cannot be altered midstream or applied retrospectively. A bench of Justices P S Narasimha and Alok Aradhe directed authorities to refund any enhanced fees collected from students during ongoing courses. The court emphasized that fee structures must be finalized before student admissions to ensure certainty and balance student interests with institutional needs. The ruling originated from an appeal by the Association of Professional Academic Institutes in West Bengal challenging a Calcutta High Court decision regarding Dr B C Roy Engineering College. The Supreme Court also stressed the necessity of institutionalising statutory fee fixation committees with proper oversight from High Courts.
Why it matters
The ruling protects professional students and their parents from unexpected financial burdens during their education while reinforcing regulatory oversight over private educational institutions across India.
