Supreme Court Says It Has Not Yet Approved or Disapproved New Form 6 for Voter Rolls

· India · Times of India, Zee News

The Supreme Court stated on Monday that it has not yet tested the validity of the new Form 6 used in the Special Intensive Revision exercise for voter inclusion and clarified it has neither approved nor disapproved it. This observation came during a hearing where a lawyer claimed the Election Commission had issued a press note suggesting the SC had upheld Form 6 while validating the SIR exercise in Bihar. Justices Surya Kant, Joymalya Bagchi, and V Mohana emphasized that the Bihar SIR judgement was delivered before the new Form 6 existed, so it does not address its validity. CJI Surya Kant also disapproved of a lawyer’s argument that the SC had purportedly observed that Form 6 was not approved, warning against citing oral observations as precedent. The bench said the new plea would be tagged with pending matters on SIR-related issues. The court indicated it will examine the validity of Form 6 in other pending cases.

Why it matters

This clarification affects the Election Commission’s ongoing voter registration drive and prevents misinterpretation of judicial remarks as binding on Form 6’s validity. Voters and political parties relying on the SIR exercise for electoral rolls now await a formal judicial determination on the form’s legality.
