Supreme Court Upholds Disqualification of Telangana MLA Danam Nagender

The Supreme Court on Thursday upheld the Telangana High Court decision to disqualify MLA Danam Nagender under the anti-defection law. A three-judge bench led by Chief Justice of India Surya Kant declined to interfere with the ruling, which set aside the Assembly Speaker's earlier refusal to disqualify the lawmaker. Nagender won the Khairatabad Assembly seat on a BRS ticket in December 2023 before defecting to the Congress in March 2024 and unsuccessfully contesting the Lok Sabha polls from Secunderabad. Senior advocate Mukul Rohatgi defended the move by citing provisions in the Constitution's Tenth Schedule, while opposing counsels argued that defection to contest another election violates disqualification rules.
