Supreme Court Upholds Order Denying OBC Reservation to Hindu Converts to Islam
· India · Times of India, Indian Express, India Today
The Supreme Court has upheld a Madras High Court ruling stating that individuals who convert from Hinduism to Islam cannot claim reservation benefits under the Backward Class category. Justices PK Mishra and Shree Chandrashekhar observed that moving from the Hindu social order to a non-Hindu social order excludes individuals from such benefits. The ruling came after the Tamil Nadu government challenged the high court decision in the apex court. The high court had previously quashed the state government's decision to recognise seven Muslim sects as Backward Classes, which had allowed Hindu Backward Class members to retain reservations after converting.
Why it matters
The ruling impacts reservation policies in Tamil Nadu and clarifies the legal parameters for granting Backward Class status to religious converts in India.
