Telangana High Court Orders Grandmother to Return 7-Month-Old Baby to Father

The Telangana High Court directed a maternal grandmother to hand over her 7-month-old grandson to his biological father, ruling that the father holds a statutory right to the child's custody. A bench of Justices Moushumi Bhattacharya and Renuka Yara issued the August 14 order after the father alleged the child was illegally detained following the death of his wife on March 31, 2026. The court observed that the father, who works in stable and well-paying employment, is better positioned to care for the child. The grandmother had opposed the handover by arguing that the father had remarried and that removing the child would cause emotional trauma. The father stated he had spent Rs 73 lakhs on hospital expenses for his late wife's terminal illness treatment before the dispute arose.
