Uttarakhand Consumer Forum Fines Food Delivery App Rs 10,520 Over Undersized Pizza

A consumer commission in Uttarakhand ordered an e-commerce food delivery platform and a restaurant to jointly pay Rs 10,520 to a customer for delivering a seven-inch pizza instead of the ordered ten-inch item. Commission President Gagan Kumar Gupta and members Dr Amresh Rawat and Ranjana Goyal ruled that the size discrepancy constituted a deficiency in service and an unfair trade practice. The customer had ordered two pizzas worth Rs 505 through the app and immediately raised the issue via customer support before filing formal complaints with the National Consumer Helpline and CPGRAMS. The delivery platform argued it operated merely as an intermediary platform connecting users with third-party restaurants without acting as the manufacturer or seller. The opposite parties must pay the total sum within 45 days, covering the pizza cost, delivery charges, Rs 5,000 for mental and physical harassment, and Rs 5,000 in litigation expenses.
